Commercial Real Estate Services

The Commercial Real Estate Services Group represents developers, owners and tenants of commercial and industrial properties, shopping centres and condominiums. Our lawyers in this group have broad experience in construction, development agreements including land acquisition and assembly, zoning matters, joint ventures, ground leases, construction contracts and property management.

The Group has a very significant institutional real estate practice representing high profile REITs and other public real estate entities, banks, trust companies and insurance companies. We provide counsel for lenders and borrowers in structuring, restructuring, negotiating, implementing and completing a wide variety of transactions including acquisitions, sales and various financing strategies for real estate projects.

Conveyancing Group

Our Conveyancing Group, comprised of lawyers and paralegals, is uniquely capable of completing a substantial volume of residential, condominium and routine commercial transactions in a cost efficient manner, while providing quality legal services.

Mortgage Remedies

The Mortgage Remedy Group focuses its practice on advice and service to financial institutions in all aspects of mortgage remedy related matters, including powers of sale, foreclosure, possession and receiverships. This Group is particularly adept at assessing complex and difficult situations proactively. As frequent counsel to lenders' lawyers on minimizing risk and exposure while maximizing return in difficult situations, the Mortgage Remedy Group is a source of confidence to clients before and following transactions.

Residential Power of Sale Sub-Group

Our Mortgage Remedy Group includes a sub-grouping of lawyers and law clerks devoted to conducting residential power of sale proceedings quickly and effectively. Our priority is to ensure that legal proceedings are initiated immediately after instructions are received, so that the lender is in a position to market each residential property without any unnecessary delay. This subgroup includes a litigation associate devoted exclusively to residential power of sale litigation including obtaining of judgments for possession (whether or not properties are tenanted) and obtaining judgment on the covenant for deficiencies.

The Residential Power of Sale Group operates with specialized computer software in a highly streamlined system which enables it to achieve the best possible results in the shortest possible time. Particular emphasis is placed on regular ongoing communications with the lender client so that it is fully informed as to the status of each proceeding at all times.

Actions on the Covenant - Commercial Mortgages

The Litigation Group members who participate in this aspect of the Mortgage Remedy process ensure that proceedings are taken without delay and that actions are pursued aggressively and expeditiously to judgment and collection.

Our Group is pleased to have been designated by Royal Bank of Canada as designated counsel in lending, litigation and bankruptcy/insolvency/work out matters.

The Real Estate Group at Minden Gross is led by Reuben M. Rosenblatt, an acknowledged leader in Canadian real estate practice. He is renowned for his encyclopaedic knowledge of case law decided across Canada relating to real estate matters. In addition to serving as a professor of real estate law for more than 20 years, and as a distinguished contributor to, and editor of academic journals, Mr. Rosenblatt was honoured as the first recipient of the Canadian Bar Association's (Ontario Division) Award of Excellence in Real Estate. He is also the recipient of the Osgoode Hall Law School Award of Excellence in teaching.
