Property and Technology
David has a multifaceted practice which
includes experience in dealing with issues in
Commercial Insolvency, Media, Technology and
Intellectual Property. David has appeared before
the Ontario Superior Court and the Registrar in
Bankruptcy on Insolvency matters, and has
appeared before the Federal Court in connection
with Copyright, Trademarks and technology
issues. He is also a Registered Trademark Agent.
David practices extensively with respect to
Insolvency, with special interest in particular
in insolvent technology companies or media
companies. He has appeared several times on
ROBTV, BNN and Canada AM to discuss insolvency
matters dealing with the insolvencies of
Teleglobe, Air Canada, Nortel, GM and Stelco,
among others.
David is the head of the
Media, Intellectual Property and Technology Group, and has
developed a specialty in representing the
interests of clients in the media and technology
sector in connection with large insolvency files
such as Nortel, Canwest, Allarco (Superchannel),
TQS Inc., PSInet and Teleglobe. His clients have
included major motion picture studios,
television production companies, international
telecommunication companies, financial
institutions, internet solution providers and
internet service providers, international and
domestic trademark holders, film and music
companies, and companies seeking restructuring.
David’s intellectual property practice includes
the negotiation of major national and
international license agreements for the use of
trademarks, copyright or other intellectual
property. David has also acted to assert the
rights of intellectual property holders against
piracy, passing off and other forms of illegal
infringement of their rights. He is also the
solicitor for the Estate of Glenn Gould.
David has been involved in several
insolvencies in the construction industry
involving complex multiparty, multi-province
issues, construction lien and trust issues. He
has also worked through the completion of
construction projects during restructurings, the
sale of construction businesses, quarries and
significant ongoing contracts for both private
and crown construction projects.
CBC News at Six and CBC Newsworld had
featured David as a commentator with respect to
the Napster issue. He has spoken at several
national level conferences on issues related to
intellectual property, the Internet, copyright,
trademark and privacy issues. David is also past
faculty at the Harris Institute for the Arts,
where he taught courses on copyright, publishing
and music industry agreements.
David received his B.A.H. in history at
Queen’s University and his LL.B. from Osgoode
Hall Law School. He was called to the Bar of
Ontario in 1999 and was the recipient of the
national Gordon Henderson prize in copyright law
in 1998 for his paper entitled “Liability Issues
in Supplying Musical Content to the Internet
Community”. He has been employed in various
facets of the Canadian publishing industry and
is a past employee of the Canadian Musical
Reproduction Rights Agency, CANCOPY and SOCAN.
David was also involved with the development of
an online system to track the use of copyright
on the Internet for the CULTECH Research Centre
at York University.
David is a director of Anaphylaxis Canada, a
national organization dedicated to inform,
support, educate, and advocate for the needs of
individuals and families living with anaphylaxis
and to conduct and support research related to
anaphylaxis.
